Official Rules

NO PURCHASE OR DONATION NECESSARY TO ENTER OR WIN. A PURCHASE OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS IS A NEED-BASED SELECTION, NOT A RAFFLE OR GAME OF CHANCE.

1. Sponsor

This Accessible Van Giveaway (the “Giveaway”) is sponsored by Spina Bifida Texas, a 501(c)(3) nonprofit organization (“Sponsor”), 16414 San Pedro Ave, Suite 345, San Antonio, TX 78232. The Sponsor is solely responsible for all aspects of this Giveaway.

2. Eligibility

The Giveaway is open to individuals who, at the time of entry, meet ALL of the following: (a) are legal residents of the State of Texas; (b) are at least eighteen (18) years of age (the individual with spina bifida may be a minor if the applicant is a parent, guardian, or primary caregiver); (c) are directly impacted by spina bifida, either personally or as a primary caregiver or family member of someone with spina bifida; (d) possess a valid Real ID Texas driver’s license, or have a designated driver in their household who possesses a valid Real ID Texas driver’s license; (e) have the ability to obtain and maintain vehicle insurance; and (f) have the financial ability to maintain the vehicle (registration, inspection, maintenance, fuel, etc.). Employees, officers, directors, and board members of Sponsor, and their immediate family and household members, are not eligible. Sponsor may request documentation verifying eligibility at any time.

3. Entry Period

The entry period begins July 1, 2026 at 12:00 AM Central Time and ends July 31, 2026 at 11:59 PM Central Time (the “Entry Period”). Entries received outside the Entry Period will not be considered.

4. How to Enter

To enter, complete the official application at spinabifidatexas.org/van-giveaway during the Entry Period. The application requires your full legal name and contact information, confirmation of Texas residency, confirmation of the eligibility criteria, information about your connection to spina bifida, information about your need for accessible transportation, and agreement to these Official Rules, the liability waiver, and the tax acknowledgment. Limit one (1) entry per person or household. Multiple entries from the same person or household may result in disqualification.

5. Winner Selection

This is NOT a random drawing. The recipient will be selected by a committee appointed by Sponsor based on demonstrated need, connection to the spina bifida community, ability to maintain the vehicle, and completeness of the application. The committee’s decision is final and binding in all respects. Selection is expected to occur within thirty (30) days after the close of the Entry Period. The potential recipient will be notified by phone and/or email, privately, prior to any public announcement. If the potential recipient cannot be contacted within seven (7) days, fails to respond, is found ineligible, or declines, an alternate may be selected. Entrants do not need to be present to be selected.

6. Prize

One (1) prize will be awarded: one (1) used wheelchair-accessible van (the “Vehicle”), a 2008 Honda Odyssey modified for accessibility, with approximately 300 miles on the odometer. The fair market value of the Vehicle will be determined at the time of award for tax reporting purposes; Sponsor makes no representation as to the Vehicle’s value. THE VEHICLE IS PROVIDED “AS-IS, WHERE-IS” WITH NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SPONSOR MAKES NO REPRESENTATIONS OR GUARANTEES REGARDING THE CONDITION, SAFETY, RELIABILITY, OR PERFORMANCE OF THE VEHICLE. Prize is non-transferable for a period of one (1) year and no cash equivalent or substitution is offered, except at Sponsor’s sole discretion.

7. Recipient Requirements

Before receiving the prize, the selected recipient must: provide proof of Texas residency; provide a copy of a valid Real ID Texas driver’s license (recipient’s or designated driver’s); sign a Vehicle Gift Acceptance Agreement, Release of Liability, and Indemnification Waiver; provide proof of insurance prior to taking possession; and pick up the Vehicle in person at a location designated by Sponsor in the San Antonio area within thirty (30) days of notification. The recipient is responsible for title transfer and registration fees and any applicable taxes. Failure to comply with any requirement may result in forfeiture, and an alternate may be selected.

8. Taxes

The prize may be considered taxable income to the recipient. RECIPIENT IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE, AND LOCAL TAXES ARISING FROM ACCEPTANCE OF THE PRIZE. Sponsor will issue an IRS Form 1099 if required by law. Recipient is strongly advised to consult a tax professional.

9. Release of Liability

By entering, each entrant agrees to release, discharge, and hold harmless Sponsor and its officers, directors, employees, volunteers, committee members, agents, representatives, successors, and assigns (the “Released Parties”) from any and all claims, damages, liabilities, costs, and expenses arising from or related to participation in the Giveaway; acceptance, possession, use, or misuse of the prize; any injury, death, or property damage related to the Vehicle; and any claims based on publicity rights, defamation, or invasion of privacy.

10. Assumption of Risk

Recipient acknowledges that motor vehicles involve inherent risks of injury, death, and property damage, and voluntarily assumes all such risks associated with the ownership, operation, and use of the Vehicle.

11. Indemnification

Recipient agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to recipient’s ownership, possession, use, or operation of the Vehicle, or any breach of these Official Rules.

12. Publicity

Except where prohibited by law, acceptance of the prize constitutes recipient’s consent for Sponsor to use recipient’s name, likeness, photograph, voice, and statements for promotional purposes without additional compensation. Recipient may be asked, but is not required, to participate in additional publicity.

13. General Conditions

Sponsor reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical failure, or any other factor beyond Sponsor’s reasonable control impairs its integrity, and to disqualify any entrant who tampers with the entry process or violates these Official Rules. If the Giveaway is canceled, Sponsor may, at its discretion, select the recipient from eligible entries received before cancellation.

14. Severability

If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Disputes and Governing Law

These Official Rules are governed by the laws of the State of Texas, without regard to conflicts of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Bexar County, Texas.

16. Privacy

Personal information collected in connection with the Giveaway will be used to administer the Giveaway. It will be kept confidential and will not be sold to third parties.

17. Recipient Name Request

To request the name of the recipient after the award, send a self-addressed, stamped envelope to: Spina Bifida Texas, Attn: Van Giveaway, 16414 San Pedro Ave, Suite 345, San Antonio, TX 78232. Requests must be received within sixty (60) days of the award date. (Note: the recipient is notified privately; public announcement is at Sponsor’s and recipient’s discretion.)
